Judge Andrew Napolitano appeared on Fox News Channel to address a federal court’s decision that determined that the State of Texas could defund Planned Parenthood. The issue has sparked debate, of which there should have been no debate. Planned Parenthood is not a government institution and provides counseling on contraception and abortions that are subsidized by tax payers.
He was interviewed by Fox News anchor Martha MacCallum.
Napolitano said that the law prohibits state funds or federal funds from being given to organizations that advocate abortion, perform abortions, or get you to an abortion provider and pays for it. The great thing is it allows the State of Texas to not fund Planned Parenthood at all, including those things that are not related to abortion, simply because it advocates abortion and gets women to abortion providers.
So the court upheld Texas’ legislatures right to do with its own money what it wants and that is not fund any organization that advocates abortion, like Planned Parenthood. This is a huge win for the pro-life movement and for unborn babies in the State of Texas.
While the Judge points out that the state cannot interfere with abortions because of the Supreme Court’s ruling, they can choose not to fund them.
Personally, I’d like to see a state challenge that and start interfering in abortions. Maybe one day they will take the federal government on in that case, just like Arizona has on the immigration issue. This will be an easy way for a civil magistrate, such as a governor of a state, to challenge the Roe v Wade ruling. If only we had people in office that really believed the pro-life position to put their political careers on the line for that belief.
MacCallum asked, “Does this decision, sort of, tip you off in terms of how this whole scenario is changing for other states?”
“In our wonderful home state of New Jersey – a lot of our listeners will be shocked to hear this – abortions are permitted up to the moment of birth,” said Napolitano. “And the state will pay for them.”
“Essentially, abortion is regulated by each of the 50 states,” he continued. “Texas is, obviously, one of the more conservative states. New Jersey is, regrettably, the most liberal.”
At least throughout the injunction and the appeals process Texas can still do what it wants with its own money and they have decided to not fund abortions or Planned Parenthood.
This really is such an easy issue. Just let the Tenth Amendment work at the federal level and let the legislature work at the state level. Planned Parenthood has been nothing but a leech on the society anyways and at the cost of many murdered unborn children.
