Santorum-backed Judge John Jones Rules Against Marriage


From Dave Weigel at Slate: "Gay marriage is legal in Pennsylvania today, following a ruling by U.S. District Judge John Jones…Who saw this coming? I'm going to guess not Rick Santorum. Twelve years ago, in his second and final term as the U.S. senator from Pennsylvania, Santorum urged the Senate to confirm Jones."

Weigel quotes Santorum as saying at the time:

"(Jones) is highly qualified to assume the important role of Judge and the duty of protecting the Constitution and ensuring the effective operation of our judicial system…and I urge my colleagues to work with the President to fill these vacancies in a timely manner."

By the way, "Judge" John Jones didn't just rule against marriage, in his opinion; he said it was time to toss marriage onto "the ash heap of history."

Now obviously I'm not trying to say Santorum, of all people, has betrayed us on marriage. There's no greater champion for the family in the current civic realm than Santorum. I'm not even sure that's a debatable point.

But I am pointing out this is yet another example of how we have absolutely no idea how to vet our judicial nominees, and that most Republicans (even the good ones) who tell you to trust them on this have no idea what it is they're talking about. Don't forget, current SCOTUS Chief Justice John Roberts was going to be the lasting legacy of George W. Bush, and in one week two years ago he was the deciding vote to stop Arizona from enforcing immigration laws as well as the upholding of Obamacare.

This ignorance stems from not-knowing the original purpose of our legal system, and the ultimate acknowledgement of where law comes from.
