We've reported on the story of Justina Pelletier and the tyrannical actions of the Massachusetts Department of Children and Families, removing her from her family and placing her into foster care. That order came as Justina had been away from her parents for nearly a year. Her father Lou Pelletier was given a gag order by the court, but he spoke out about what was taking place. However, Liberty Counsel came alongside the Pelletier's and we are happy to report that after sixteen months, a Massachusetts judge ordered Justina Pelletier to be returned to her parents, and she arrived home shortly before noon on Wednesday.
Judge Joseph F. Johnston ruled:
I find that the parties have shown by credible evidence that circumstances have changed since the adjudication on December 20, 2013, that Justina is a child in need of care and protection pursuant to G.L. c. 119, §§ 24-26. Effective Wednesday, June 18, 2014, this care and protection petition is dismissed and custody of Justina is returned to her parents, Linda and Lou Pelletier.
While the ruling is good, there are some things that still seem to be an overreach of government. For instance, he adds:
JRI (Justice Resource Institute Susan Wayne Center for Excellence) collaborated with Justina's family, MA DCF, and other collaterals in developing an appropriate plan identifying the necessary support and services for Justina's return home. The plan addresses medical care and case management, daily access to special education services, individual therapy, and family therapy. Most of these services are ready to begin immediately and others very shortly. I credit the opinion of the director of JRI that with the many qualified, trained professionals assisting in Justina's care, should an urgent situation arise, there will be immediate assessment, intervention, and support for Justina. It is a solid plan for Justina and her family that addresses Justina's complex needs.
Again, one has to ask what business DCF has being involved in something they never should have been involved in in the first place. You can rest assured they will continue to attempt to hound this family in the future.
But for now, Justina is home where she belongs, with mom and dad. Check out the heartwarming video of her father carrying her into the house on Wednesday.
Matt Staver of Liberty Counsel said, We are thrilled that Justina will finally be returning home. The family looks forward to putting this 16-month nightmare behind them. Justina and her family now begins the process of healing both physically, emotionally, and spiritually."
In an interview, Justina said she was excited to get back to normal activities. "I'm so happy. I'm so excited, oh, my gosh," she said. "It's such big news."
Though Staver would neither deny nor confirm the Pelletiers were planning a lawsuit he told The Blaze, "There is a real strong desire by everyone involved, even the community, to make sure the people responsible are held accountable."
"We don't want other families to have to experience what the Pelletier family has gone through in the last 16 months," he said.
Richard Mast, a litigation attorney with Liberty Counsel, told Freedom Outpost that they are considering legal action, but as of yet have not determined who they will be specifically targeting. He does believe that within the next month, the next step in the Pelletier case will be in the news.
Mast also said that Liberty Counsel wants to come alongside those who are following the law and are then targeted by an abusive government system. Specifically, Mast told Freedom Outpost that they long to come alongside Christians who "act within the realm of what the Bible says and stand based on what Scripture says and they exercise their rights under the First Amendment in a winsome and appropriate manner… we will stand behind Christians who seek to spread the gospel and who speak truth to the culture."
Clearly the Pelletiers weren't doing anything unlawful and Liberty Counsel has shown their courage to come alongside them and defend them.
Last February, Justina got the flu and was taken to Boston Children's Hospital.
Doctors determined that she had been misdiagnosed. Instead of mitochondrial disease, Justina has been diagnosed with Somatoform disorder, which is considered a mental disorder.
Her parents wanted to take their daughter home, but instead, were escorted by security out of the hospital. Four days later they found out they lost custody of their daughter. Mr. Pelletier said it was kidnapping. I agree it was.
Today marks a big step in the fight against so-called Child Protective Services. As a father that has had to deal with the absolute incompetence of the system, the abusive nature of their administrative procedures and the secrecy they operate under, it is my hope that every individual from doctors and nurses to law enforcement and DCF employees are held accountable, removed from their employment and never allowed to hold a job in that capacity again.
