In more federal tyranny, a federal judge fined David Daleiden of Center for Medical Progress (CMP), the man behind exposing the unlawful sale of murdered baby's body parts by Planned Parenthood, and his attorneys $200,000 for what he calls contempt of court for releasing more undercover videos that exposed the lawless nature of Planned Parenthood's illegal practices.
The Washington Times reports:
Mr. Daleiden’s attorneys, Steve Cooley and Brentford Ferreira, were included in the sanctions intended to ensure “current and future compliance” with the order.
Mr. Daleiden described the sanctions as an attack on his rights to defend himself. Matthew Geragos, an attorney for Cooley and Ferreira, told the Associated Press that he is appealing.
Mr. Daleiden’s California-based Center for Medical Progress filed earlier this month for a petition for writ of certiorari with the U.S. Supreme Court to appeal the “unconstitutional gag order” preventing the release of the undercover footage.
“Judge Orrick’s gag order, issued at the behest of Planned Parenthood and the National Abortion Federation, is an unprecedented attack on the First Amendment by a clearly biased federal judge,” said Mr. Daleiden in an Aug. 3 statement.
Daleiden is correct. Since Congress cannot write a law that infringes upon the press nor the exercise of free speech, the judge's order has no basis in law to keep Mr. Daleiden from presenting video evidence of criminal activity.
In this case, the judge has called good evil and evil good.
The judge says nothing of the murder of the unborn and the unlawful trafficking of their dismembered bodies and harvested organs. He says nothing of the murder of babies that takes place outside the womb in order to harvest organs either.
Daleiden and company are not taking it sitting down either.
He and CMP have appealed the judge's unconstitutional gag order to the US Supreme Court.
Today, David Daleiden and The Center for Medical Progress filed their petition for a writ of certiorari at the United States Supreme Court, appealing the unconstitutional gag order issued by San Francisco Judge William Orrick III against the publication of undercover footage of top-level Planned Parenthood leadership at the National Abortion Federation’s annual trade shows. The petition argues that no federal court has ever upheld a prior restraint like Judge Orrick’s gag order to suppress speech of overwhelming public interest:
“At issue in this appeal is a gag order, a preliminary injunction imposed specifically for the purpose of hiding information from the public, precisely because the information is of such significant public interest and concern—the procurement and sale of aborted fetal body parts.”
CMP project lead David Daleiden says, “Judge Orrick’s gag order, issued at the behest of Planned Parenthood and the National Abortion Federation, is an unprecedented attack on the First Amendment by a clearly biased federal judge. Judge Orrick even wants to press his gag order in the California Attorney General’s bogus criminal case against me—though he, NAF, and Planned Parenthood insist the gag order only applies to my defense, and not to the Attorney General’s bogus prosecution.”
As a key leader of the “Good Samaritan Family Resource Center” in San Francisco, Judge Orrick helped open and fund a Planned Parenthood Northern California clinic inside the Center’s headquarters. Planned Parenthood Northern California has membership in the National Abortion Federation and is a named plaintiff against CMP and Daleiden in Judge Orrick’s courtroom. A motion to disqualify Judge Orrick is still pending.
"The gag order against the release of CMP’s footage of Planned Parenthood leadership discussing criminal conduct at National Abortion Federation Meetings is an attack on the First Amendment and an attack on the constitutional separation of powers," wrote CMP.
"These videos are now unquestionably information the public is entitled to, and they are key evidence in the charges and defense of David Daleiden and Sandra Merritt, but the gag order even prevents their release to law enforcement," the organization added.
"Planned Parenthood’s barbaric abortion business, and their political cronies and tyrannical judicial sycophants, cannot cover up these videotapes and stifle free and informed public discussion," CMP continued. "CMP will continue to fight this unconstitutional abuse of power and vindicate our First Amendment rights and those of all citizen journalists to speak and publish on matters of urgent public concern."
