Indiana Makes Move to Nullify Obamacare

So far we've seen several states push forward legislation to nullify the Affordable Care Act, aka Obamacare. Among those are Oklahoma, Georgia, South Carolina and Tennessee. Following the filing of a lawsuit by Indiana school districts in October, Indiana has introduced legislation to nullify the monstrous healthcare law.

Rep. Timothy Harman, along with two co-authors, introduced HB1406 on January 15, 2014. The bill, if passed and signed into law, would effectively nullify Obamacare in the state of Indiana.

The bill was promptly transferred to the House Ways and Means Committee.

The bill forbids the state and its employees, officers, or officials from "acting on behalf of the state, engage in an activity that aids any person in the enforcement of the Patient Protection and Affordable Care Act."

The legislation would also prevent "the state and political subdivisions of the state, including counties, municipalities, and special purpose districts" from establishing "an exchange for the purchase of a health plan" or participating in or purchasing "a health plan from an exchange established by a nonprofit organization."

The legislation will need a majority vote in order for it to be considered by the full Indiana House.

Michael Lotfi writes, "The bills legal argument is rooted in anti-commandeering doctrine, which has been established by multiple Supreme Court cases, including Printz vs. United States. This doctrine states that the federal government cannot force or coerce states into carrying out federal law, regulations or programs."

According to the Tenth Amendment Center, you can have a major impact on this legislation. They recommend the following:

1. Call the Committee Chair, Timothy Brown.  Strongly, but respectfully urge him to move this important bill forward to a vote in his committee.  A phone call has 10x the impact of an email.


2.  Call the rest of the committee members.  Again, be strong, but respectful. Urge each of them to take action to move the bill forward and vote YES on HB1406.  If they do not commit to a YES vote, ask them why.  If they're undecided, let them know you'll call back in a few days.

5.  Write a letter to the editor Look up your local newspaper and submit a letter to the editor voicing your support for HB1406. Following strong legal principles, it's essential that Indiana no longer help the federal government carry out the Affordable Care Act. Passing HB1406 will start that process.

    Good for Indiana hopefully it will pass and more states will move in the same direction. Remember it is the United States of America. The more this is dealt with at the state level the more likely it will self terminate this monstrosity.

    I sure hope that many more states jump on this band wagon!! Obamacare is a disaster and Obama and Democrats know it, they just can't/won't admit it!!! In the meantime, Americans suffer!!!!!

    It won't hold up at all. Printz is about compelling state and local agencies to enforce federal laws, not about federal agencies enforcing federal laws inside states. The IRS (a federal agency) is going to enforce the law inside the state, there isn't any precedent that says the state can prevent that. They can prevent their own agencies from doing anything to help, but they can't stop the IRS from doing what they want. And since their own agencies have already not been helping, it doesn't change anything.

    Even preventing public employees from using non-profit healthcare in Indiana is absolutely meaningless. Anthem has nearly a total monopoly in Indiana and is for-profit.

    Just another way for politicians to pretend they're doing something while accomplishing nothing.

Harman is making a play for the Obama haters and their money -- but at the expense of Hoosiers who are going to be going without medical care or going without their house because of medical bills they can't pay.       The "SO CALLED" affordable (?) healthcare bill is a huge scam on this nation. As of this morning's news, the website is STILL riddled with unworkable items. Your identification and all of your most private financials are ripe for the picking. Do you really think that this fiasco will work? Even the insurance companies are at risk of bankruptcy, and the obamacare is also ready to fold like a deck of cards. Do you really trust the democrats with your healthcare??? If you do, you are a fool.

      Even if it's a scam, even if it's as insecure as Target, even if insurance companies might go bankrupt, and even if there is folding, do you want to be uninsured? Really? This bill is just about helping or not helping people get insured. That's all it tries to do. You can still go to a Republican doctor and get benefits from a Republican insurance company.

      If the insurance companies will not cover you, why would you want to give the government your hard earned dollars? This bill is totally partisan (democrat) without one republican vote. The general population (over 60%) did not want it or need it. If you are an undocumented alien, AKA, an illegal immigrant, I could understand why you think this is such a peachy deal, but for the average American, the whole thing stinks to high heaven.

      You may be under the impression that the ACA involves handing your hard-earned money to the government, but that's not it at all. You hand it to insurance companies. Responsible people who want to be able to pay their medical bills, even if they're very expensive, get medical insurance from insurance companies. A good way to do that is through the ACA marketplaces. I recently sent money to Blue Cross Blue Shield to pay for my family's Obamacare. Last year insurance companies didn't cover a lot of people, but now they cover anyone who applies. Including people with pre-existing conditions, which is most of us, but not including illegal aliens.
