Texas Officers Illegally Arrest Citizens for Carrying Antique Black Powder Pistols


Open Carry Texas is a grassroots organization that seeks to educate the public about open carry in order to get public support for the next legislative session.

The organization's website states: Open Carry Texas (OCT) is an organization dedicated to the safe and legal carry of firearms openly in the State of Texas in accordance with the United States and Texas Constitution and applicable laws.

amosarrestedOpen Carry Texas has gained much attention recently. Benswann.com's Kristin Tate reported on a peaceful 2nd Amendment rally they organized last week.

Today, however, 2 members of Texas Open Carry were arrested on the TX state capitol.

According to the Open Carry Texas Facebook page the two men arrested were upgraded to class A misdemeanor charges, criminal trespass with deadly weapon. (Pick up the video around the 7:30 mark. Warning: Strong Lanugage)

Joshua Cook asked Vice President and Chief Communications Officer Victoria Montgomery about what happened today. Listen to the exclusive interview below.

Our purpose is to 1) educate all Texans about their right to openly carry rifles and shotguns in a safe manner; 2) to condition Texans to feel safe around law-abiding citizens that choose to carry them; 3) encourage our elected officials to pass less restrictive open carry legislation for all firearms, especially pistols; and (4) foster a cooperative relationship with local law enforcement in the furtherance of these goals with an eye towards preventing negative encounters.

    Our country is lost! When we have officials of the government who so clearly violate the law like this there is no hope for our republic. Every one of these police scum need to be summarily fired! I hope those arrested are suing for huge amounts. The State must pay for this gross abuse of power.

    Citizen's arrest for false imprisonment would have been correct for every one of those "officers" for kidnapping..
    Until WE THE PEOPLE PUT A STOP TO THIS, IT IS ONLY GOING TO GET WORSE.. our rights are being trampled on and no one did anything..

    Those policeman can be arrested, handcuffed, and taken to jail by the citizens of this once great country, and rapidly descending Texas. This is my state and now I am saddened by the police breaking the laws and getting away with it..

    There was a time when any conservative would stand
    in support of law enforcement. No more.

    I often hear the tired refrain, "A few bad cops...".
    No way a "few". There are a lot of bad cops--closer to 50%,
    and the other half of the cops will stay quiet about the bad half.
    There are way more than a few bad cops.
    If you are a brutal low-brow bully,
    and you want to make a career out of it,
    then you become a cop.

    And so, cops get suspended with pay, again.
    How many times have we heard that ?
    In the corrupt world of cops, that is called punishment.
    In the real world, that is called a vacation.

    This sort of behavior by cops is too, too frequent.
    There are two kinds of stories about cops.
    The dumb cop story, and the corrupt cop story.
    Unfortunately, these stories are always true.
    Cops have changed. They are not what they used to be.
    I used to be a supporter of law enforcement.
    I used to trust cops.
    I don't trust cops anymore.

    I find it hard to believe that Texas, of all places doesn't have 'Open Carry' ! I hail from Ohio, originally, where 'Open Carry' has been on the books for as long as I've been aware.

    It's permitted 'As long as it doesn't create an 'Alarm' .
    Interestingly enough, Texas also restricts/forbids the carrying of a 'Bowie knife'. Strange, since Texas and the last stand at the Alamo is where Jim Bowie gained historical recognition.
    I currently live in South Carolina, where the open carrying of such knives is permitted, once again, as long as there is no 'Alarm' created.

    Recently California passed legislation that bans the open
    carrying of a handgun in public even if it is not loaded. Florida, Illinois,
    Oklahoma and Texas also ban the open carry of handguns in some instances.

    The Second Amendment lists both the “right to keep “AND BEAR” arms”. (My Bold)

    In the English language “bear” has several meanings besides
    the name of the large animal that graces the California state flag.

    Definition of to BEAR: to carry, transmit, transport, have a
    characteristic of and exhibit.

    It seems pretty clear to me that laws banning open carry are
    in direct violation of the Second and Fourteenth Amendments.

    Fourteenth Amendment, Section1

    “No state shall make or enforce any law which shall abridge
    the privileges or immunities of citizens of the United States”….

    The Second Amendment does not say; you may bear arms except in
    a public place, on your car seat or list any other place where the Second
    Amendment does not apply.

    Unless I have been asleep, I have not heard of the Second Amendment
    being repealed or rewritten or the dictionary’s definition of the verb “to
    bear” changed. If politicians or the courts can change or interpret the English
    language at their whim, our country is in very serious trouble. When they
    actually, for all intent and purposes, remove words from The Constitution, the
    situation has become critical.

    I moved to Texas from New York four years ago. I've been handling weapons since I was eleven. I was under the impression that Texas was more rational about guns than New York. But, when I read about incidents like this I wonder how long it will be before the government succeeds in disarming us.
