Senate Majority Leader Harry Reid Admits Senate-Passed Amnesty Bill Is UnConstitutional


Texas Congressman Steve Stockman announced on Thursday that Senate Majority Leader Harry Reid is now refusing to transmit to the House of Representatives the amnesty bill, which the Senate voted on and passed two weeks ago. According to Stockman he believes Reid fears it will be returned to the Senate on a "blue slip" resolution, which he threatened to use to kill the bill in the House.

"Even Harry Reid now admits the Senate's amnesty bill is unconstitutional and cannot become law.  Any bill that raises revenue must start in the House" said Stockman. "By creating their own amnesty taxes Senate Democrats broke the rules. Senate Democrats were so hell-bent on ramming through a gift to radical political activists they didn't bother to check if it was even legal." 

"They got caught trying to sneak an illegal bill past the Constitution's borders," said Stockman.

A blue slip" is a resolution that automatically returns to the Senate any bill that violates the "origination clause" of the United States Constitution.  The origination clause states "All Bills for raising Revenue shall originate in the House of Representatives."  The name comes from the blue paper the resolution is traditionally printed on.

Blue slip resolutions are immediately considered as a matter of constitutional privilege, are debatable for an hour and are not subject to amendment.

According to Stockman's press release, "Section 2102 of the amnesty bill requires the payment of certain taxes and forgives the payment of other taxes as a condition of receiving amnesty and other benefits. The Congressional Budget Office analysis of S. 744, dated June 18, 2013, on page 44 states, in part, that 'enacting S. 744 would have a wide range of effects on federal revenues, including changes in collections of income and payroll taxes, certain visa fees that are classified as revenues, and various fines and penalties. Taken together, those effects would increase revenues by $459 billion over the 2014-2023 period, according to estimates by JCT and CBO.'"

Well isn't that special? So now if we were wondering why Boehner isn't killing the bill, perhaps this is the reason. Was the Senate bill a test to see if they can get it through and to put more pressure on Republicans in the House to compromise America's economy and security to appease Socialist Democrats? Time will tell.

    If than this is true, that they passed it, and it is truly Unconstitutional, than that makes all that voted for it felons and traitors to the country, let's put all of them on trial and get them into prisons.

    Any amnesty for Criminal Invaders (aka Illegal Aliens) and nationalized medical care, such as Obamacare, are unconstitutional and therefore illegal. The House should not allocate any funds for either and that would stop them from ever being implemented.

    Congress MUST start standing up to the abuses of the Executive Branch which are legion! Obama has issued more than 20,000 Executive Directives, all of which are illegal and therefore not binding. These must all be canceled summarily!

    We need to demand that the House and Senate start doing their jobs... of reining in an out-of-control Whitehouse! Obama should not only be fired... but arrested for his many violations of the Constitutional limitations that he regularly totally disregards!

    If they make amnesty a law, as they pulled off with OamaCare, this time they will see Mob Rule of a different kind than they have been working with -- one aimed at their own heads.
    I'm only guesing, of course, they may escape this failing coup with more than their lives.
    In any case, if the Political Class cannot be stopped they will end up being in charge of absolutely nothing but left over empty promises.

    Is there anyone in the Church of Latter Day Saints that can begin excommunication procedures towards Harry Reid. A good place to begin is how he lied about Mitt Romney, calling a fellow member a liar. Get that done, get it in the media everywhere you can and let the issues flow where they may.

    What gets me about this whole stinking deal, is that ObamaCare is now a national healthcare system that has been allocated over to the IRS, and not to an "American medical cerified board of doctors..." The IRS does not care about your health, just the tax revenue it brings...a Patriot!

      Because it's a standard liberal tactic..... it isn't unconstitutional until SCOTUS says so. That can take years. As Bill Clinton supposedly once said, "I ain't guilty until I've lost my last appeal". In case you haven't noticed, the Democrats are not big on Constitutional restrictions on government.

      If Republicans can't stand up to the Democrats, call for re-call votes, we are stuck with Democrat arrogance and stupidity. The voters at home have to become upset enough with their Democrat rulers to enact recalls on their own politicians which will tell Democrats that their methods and actions are no longer acceptable.

    If it didn't originate in the lower house, then it's unconstitutional, Gop leaders know that, it raises revenue, now they wont have to close the border. Harry Reid knew that when he brought it before the senate, he will fix it before it goes to the house of reps. It will fail, and we wont enforce current laws, so just bus as usual. What a bunch of idiots.

      It isn't illegal to him until the courts say so. Liberal lawyers LOVE making new law without the interference of Congress. ObamaCare didn't originate in the House either, and the SCOTUS said it was valid if it was considered a tax, totally ignoring the Origination Clause because it was not raised as an issue by the parties involved in the case. This was outrageous because the Administration argued over and over that it was NOT a tax. Roberts was way out of line on this decision, because he ruled on a question that was not asked, and ignored that part of the Constitution that said that the rationale for his decision was, itself, a violation of the Constitution. You can't make this stuff up!

    Obamacare, which was judged to be a tax by the Supreme Court, originated in the Senate if my memory serves me correctly. I remember some making the argument back then that Obamacare was therefore unconstitutional. I believe those arguments are correct. But the Constitution doesn't seem to matter anymore unless it helps the Left, at least not hinder them.

    So is the Senate originated Obamacare bill. The Constitution clearly states that all taxes originate in the House of Representatives. When Roberts declared that Obamacare was a tax, it instantly became unconstitutional.
    Time to defund the Senate.

    So, if they will admit this, what else will they do? Folks, there comes a time to call truth "truth"! These people are "traitors" to this nation. Since they seem to have all the power, the "good guys" better start thinking how these "bad guys" can be removed from power! If they remain, there is no future for this nation. Notice, not one of these so-called "leaders" has stood up to the ACLU, nor to the Democrat "machine" that "booed" God at the DNC. Anywhere God "is" is to them a hostile work environment! This nation was founded on God's precepts and principles from His word. It was imbedded in our culture, but over the past five decades, it has been systematically removed by the Marxist/Socialist/ Communist forces whose satanic mission it is to bring down America. God has responded to this denial of His Being by simply removing His blessing and grace from America! Every country or empire where this has happened has gone down from within.
