NC Senate Passes Anti-Sharia Bill

Fight on, freedom lovers . The law stops judges from considering foreign law when it violates a citizen's constitutional rights (like this).

RALEIGH — The state Senate on Friday passed a bill that would keep courts from recognizing Sharia law.

While proponents of the legislation said it would keep people safe from foreign laws, critics derided the bill as sending a message of intolerance and bigotry to followers of Islam.

The Senate had already approved the measure when it was attached to a controversial measure that would impose stricter regulations on abortion providers in the state. But the foreign law provision wasn't sufficiently critiqued because abortion overwhelmed the floor debate, said Sen. Floyd McKissick, a Democrat from Durham.

Now called House Bill 522, the provision's contents haven't changed. It reminds judges that the U.S. and N.C. constitutions are the law of the land and no foreign law can supersede them. Sometimes international laws are used in court as evidence before a judge, or in written opinions. But this bill would stop judges from considering foreign law when it violates a citizen's constitutional rights.

"Unfortunately we have judges from time to time … that sometimes seem to forget what the supreme law of the land is, and sometimes make improper rulings," said Sen. E.S. "Buck" Newton, a Wilson Republican and the legislation's Senate sponsor.

Though the bill doesn't specifically mention it, Newton was clear during Friday's session that the legislation targets Sharia law, a legal system based on the religious and moral tenants of Islam. Few Muslim countries apply the entire body of rules, instead choosing measures relevant to them. More than 60 countries use at least part of Sharia law in their governance.

Its improper use has "worked to deprive" U.S. citizens and immigrants of their constitutional rights, Newton said. There have been 27 reported cases around the country in which Sharia law has been used, he added.

More than 20 states have introduced legislation banning Sharia law or foreign law in state courts. Many bills – including North Carolina's – would apply only to cases in which the application of foreign law would violate a person's constitutional rights.

Sen. Ellie Kinnaird of Chapel Hill, a Democrat, said she thinks the bill's sponsors don't truly mean to inform judges that foreign law is unacceptable, but rather the people of North Carolina.

"I think the audience is really wider," Kinnaird said.

The N.C. Bar Association opposed the bill in its former incarnation, House Bill 695. The American Bar Association said in a resolution that the passage of such bills will have a "widespread negative impact on business, adversely affecting … economic development in the states in which such a law is passed and in U.S. foreign commerce generally."

The danger doesn't come from the legislation's exact wording, said Omid Safi, a professor of religious studies at UNC-Chapel Hill. He contends this wave of anti-foreign-law legislation comes from a fundamental misunderstanding of Sharia law and a "bigoted" perception of Muslims.

"We would be delighted to have a conversation about what Sharia law actually is and what it is not," he said. "It would be important, if we're passing legislation on the topic, for (lawmakers who support the bill) to actually benefit from the expertise of people who might actually know something about the subject."

The bill wouldn't affect only Sharia law. Jewish organizations have spoken out against anti-foreign-law legislation across the United States because the measures could negate the common Jewish practice of resolving disputes according to their religious laws, Halacha.

Is it then in vanity that they believe and in the grace of Allah that they disbelieve? (90)Fulfil the covenant of Allah when ye have covenanted, and break not your oaths after the asseveration of them, and after ye have made Allah surety over you. Lo! Allah knoweth what ye do. (99) His power is only over those who make a friend of him, and those who ascribe partners unto Him (Allah). (100) And when We put a revelation in place of (another) revelation, - and Allah knoweth best what He revealeth - they say: Lo! thou art but inventing. Most of them know not. (101) Say: The holy Spirit hath revealed it from thy Lord with truth, that it may confirm (the faith of) those who believe, and as guidance and good tidings for those who have surrendered (to Allah). (102) And We know well that they say: Only a man teacheth him. The speech of him at whom they falsely hint is outlandish, and this is clear Arabic speech. (103) Lo! those who disbelieve the revelations of Allah, Allah guideth them not and theirs will be a painful doom. (104) Only they invent falsehood who believe not Allah's revelations, and (only) they are the liars. (105) Whoso disbelieveth in Allah after his belief - save him who is forced thereto and whose heart is still content with the Faith - but whoso findeth ease in disbelief: On them is wrath from Allah. Theirs will be an awful doom. (106) That is because they have chosen the life of the world rather than the Hereafter, and because Allah guideth not the disbelieving folk. (107) Such are they whose hearts and ears and eyes Allah hath sealed. And such are the heedless. (108) Assuredly in the Hereafter they are the losers. (109) Then lo! thy Lord - for those who became fugitives after they had been persecuted, and then fought and were steadfast - lo! thy Lord afterward is (for them) indeed Forgiving, Merciful. (110) On the Day when every soul will come pleading for itself, and every soul will be repaid what it did, and they will not be wronged. (111) Allah coineth a similitude: a township that dwelt secure and well content, its provision coming to it in abundance from every side, but it disbelieved in Allah's favours, so Allah made it experience the garb of dearth and fear because of what they used to do. (112) And verily there had come unto them a messenger from among them, but they had denied him, and so the torment seized them while they were wrong-doers. (113) So eat of the lawful and good food which Allah hath provided for you, and thank the bounty of your Lord if it is Him ye serve. (114) He hath forbidden for you only carrion and blood and swineflesh and that which hath been immolated in the name of any other than Allah; but he who is driven thereto, neither craving nor transgressing, lo! then Allah is Forgiving, Merciful. (115)And speak not, concerning that which your own tongues qualify (as clean or unclean), the falsehood: "This is lawful, and this is forbidden," so that ye invent a lie against Allah. Lo! those who invent a lie against Allah will not succeed. (116) A brief enjoyment (will be theirs); and theirs a painful doom. (117) And unto those who are Jews We have forbidden that which We have already related unto thee. And We wronged them not, but they were wont to wrong themselves. (118) Then lo! thy Lord - for those who do evil in ignorance and afterward repent and amend - lo! (for them) thy Lord is afterward indeed Forgiving, Merciful. (119) Lo! Abraham was a people obedient to Allah, by nature upright, and he was not of the idolaters; (120) Thankful for His bounties; He chose him and He guided him unto a straight path. (121) And We gave him good in the world, and in the Hereafter he is among the righteous. (122)And afterward We inspired thee (Muhammad, saying): Follow the religion of Abraham, as one by nature upright. He was not of the idolaters. (123) The Sabbath was appointed only for those who differed concerning it, and lo! thy Lord will judge between them on the Day of Resurrection concerning that wherein they used to differ. (124) Call unto the way of thy Lord with wisdom and fair exhortation, and reason with them in the better way. Lo! thy Lord is Best Aware of him who strayeth from His way, and He is best aware of those who go aright. (125) If ye punish, then punish with the like of that wherewith ye were afflicted. But if ye endure patiently, verily it is better for the patient. (126) Endure thou patiently (O Muhammad). Thine endurance is only by (the help of) Allah. Grieve not for them, and be not in distress because of that which they devise. (127) Lo! Allah is with those who keep their duty unto Him and those who are doers of good. (128)

      Why are you still talking you anti American dill weed? Your justification of Shariah law is not welcome here in this country and if you are so hell bent on trying to convince someone of how right you are give me your address and I will send money for a one way ticket back to your parking lot of a homeland so you can flap your gums to a bunch of Islamic terrorists who I am sure will be more than happy to listen to you rant on and on about what you feel is good for this country. Go read a bible and do some research on American Government and history and I will guarantee you find no references to Shariah law in American government. Shariah law is only the law of people that want to advance the will of a false god and exterminate all that do not believe as they do. There is no room for such laws in this country and if you don't like it then my offer stands as stated above.

    It's very simple, if you live in the United States, you live under its laws; if you want to go by other laws contrary to the dictates of US law, go live in one of those countries who espouse those laws. Don't try to supersede US jurisprudence with foreign laws.

    I see that here the Sharia is used as a ball to play with,because it is not applied 100% in Islamic countries,and can´t be applied towards non muslims,because if there other religion ,the christians for example have their Sharia respect to religious affairs ,and the majority of laws applied are emited by Judges and parliaments...and many non-islamic countries take the Sharia laws to be studied,and to apply some of these laws, that suit to these countries,and if the the majority of the sharia are issued by God, then should be better than that that issued by men,because knows all,and man knows some or what God allowed to him of knowledge,and God says: O You who Believe,! You have a life in the punishment,You that have mind to think ..and frm theses law for example

    so I recomendo to all american to seek meat (Bovine,Ovine,Caprine,Bufalo) slaughtered bt the Kosher and Halal manner,and to leave the pork meat, because it is very harmfull, and the pork was created by God to be a recycler and not be eaten (exept if there were no other food, and was necessary to eat keep alive in a hard situation..

    When Muslim countries start considering the Constitution and the 10 Commandments then I'll start considering Sharia law. Until then if Muslims are worried about bigotry in this country then I suggest that they take their hypocritical butts and their perverted religion to places where they'll be more welcome-like Afghanistan for instance.

      Two Scriptures for you to consider. In John 14:6 Jesus says " I am the way,the truth and the life. No one comes to the Father but by Me." In Philippians 2:9-11 the Scripture says " Therefore God has highly exalted Him,and given Him a Name which is above every other name,that at the Name of Jesus every knee should bow,of heavenly ones,and of earthly ones,and of ones under the earth,and that every tongue should confess that Jesus is Lord,to the glory of God the Father." You may accept or reject those verses as you like but they are the truth regardless of what you believe or what the Koran says. I urge you to reject the lie of Islam and turn to the truth of God in Christ before it's eternally too late.

(154) And this is a blessed Scripture which We have revealed. So follow it and ward off (evil), that ye may find mercy. (155) Lest ye should say: The Scripture was revealed only to two sects before us, and we in sooth were unaware of what they read; (156) Or lest ye should say: If the Scripture had been revealed unto us, we surely had been better guided than are they. Now hath there come unto you a clear proof from your Lord, a guidance and mercy; and who doeth greater wrong than he who denieth the revelations of Allah, and turneth away from them? We award unto those who turn away from Our revelations an evil doom because of their aversion. (157) Wait they, indeed, for nothing less than that the angels should come unto them, or thy Lord should come, or there should come one of the portents from thy Lord? In the day when one of the portents from thy Lord cometh, its belief availeth naught a soul which theretofore believed not, nor in its belief earned good (by works). Say: Wait ye! Lo! We (too) are waiting. (158) Lo! As for those who sunder their religion and become schismatics, no concern at all hast thou with them. Their case will go to Allah, Who then will tell them what they used to do. (159) Whoso bringeth a good deed will receive tenfold the like thereof, while whoso bringeth an ill-deed will be awarded but the like thereof; and they will not be wronged. (160) Say: Lo! As for me, my Lord hath guided me unto a straight path, a right religion, the community of Abraham, the upright, who was no idolater. (161)Say: Lo! my worship and my sacrifice and my living and my dying are for Allah, Lord of the Worlds. (162) He hath no partner. This am I commanded, and I am first of those who surrender (unto Him). (163) Say: Shall I seek another than Allah for Lord, when He is Lord of all things? Each soul earneth only on its own account, nor doth any laden bear another's load. Then unto your Lord is your return and He will tell you that wherein ye differed. (164) He it is Who hath placed you as viceroys of the earth and hath exalted some of you in rank above others, that He may try you by (the test of) that which He hath given you. Lo! Thy Lord is swift in prosecution, and Lo! He verily is Forgiving, Merciful. (165)

    I always thought a foreign law like Sharia COULD NOT be used inside the US. All common sense seems to have gone by the wayside with the advent of Obama and his disregard for the rule of law and the Constitution. I never thought to see so much idiocy inside the US.

    NC is looking better and better as a place to join fellow liberty and freedom lovers, because I have to get the FLU@K out of Oregon. It has turned into a utopia for illigal mexicans, russians, and progressives( SOCIALISTS ) ! What a shame too, I used to be proud to say I was an Oregonian, now it makes me vomit in my mouth to say it and I am deeply saddened by that.
