Missouri: Legislation Demands Owners Turn In Guns Within 90 Days


Democrats from several states are attempting to push through gun control legislation all over the country. The latest is in Missouri, where Democrats are out to make law abiding gun owners outlaws, requiring them to turn in their firearms within 90 days.

Representative Rory Ellinger sponsored the bill and Reps. Jill Schupp, Margo McNeil, Walton Gray were co-sponsors.

Sounding similar to the Feinstein assault weapons ban bill and the numerous bills I wrote about that Colorado Democrats have introduced, Point 4. of House Bill 545 reads:

4. Any person who, prior to the effective date of this law, was legally in possession of an assault weapon or large capacity magazine shall have ninety days from such effective date to do any of the following without being subject to prosecution:

(1) Remove the assault weapon or large capacity magazine from the state of Missouri;

(2) Render the assault weapon permanently inoperable; or

(3) Surrender the assault weapon or large capacity magazine to the appropriate law enforcement agency for destruction, subject to specific agency regulations.

But the devil is in the details. If you think this is only about AR-15s and Ak-47s, you would be sadly mistaken. The legislation defines what it means by "assault weapon" in Point 1.:

571.023. 1. As used in this section the following terms shall mean:

(1) "Assault weapon", any:

(a) Semi-automatic rifle that has the capacity to accept a detachable magazine and has one or more of the following:

a. A pistol grip or thumbhole stock;

b. Any feature capable of functioning as a protruding grip that can be held by the nontrigger hand;

c. A folding or telescoping stock; or

d. A shroud attached to the barrel, or that partially or completely encircles the barrel, allowing the bearer to hold the firearm with the nontrigger hand without being burned, but excluding a slide that encloses the barrel;

(b) Semi-automatic pistol, or any semi-automatic, centerfire or rimfire rifle with a fixed magazine, that has the capacity to accept more than ten rounds of ammunition;

(c) Semi-automatic pistol that has the capacity to accept a detachable magazine and has one or more of the following:

a. Any feature capable of functioning as a protruding grip that can be held by the nontrigger hand;

b. A folding, telescoping or thumbhole stock;

c. A shroud attached to the barrel, or that partially or completely encircles the barrel, allowing the bearer to hold the firearm with the nontrigger hand without being burned, but excluding a slide that encloses the barrel; or

d. The capacity to accept a detachable magazine at any location outside of the pistol grip;

(d) Semi-automatic shotgun that has one or more of the following:

a. A pistol grip or thumbhole stock;

b. Any feature capable of functioning as a protruding grip that can be held by the nontrigger hand;

c. A folding or telescoping stock;

d. A fixed magazine capacity in excess of five rounds; or

e. An ability to accept a detachable magazine;

(e) Shotgun with a revolving cylinder; or

(f) Conversion kit, part, or combination of parts, from which an assault weapon can be assembled if those parts are in the possession or under the control of the same person.

They don't want just semi-automatic rifles. They want all sorts of firearms. Do you have a Glock 17 or 19 semi-automatic pistol? Yep, you would be required to turn it in or become an outlaw. These are just examples of the kinds of firearms that I wrote about concerning Feinstein's gun grab bill, and yes for all those naysayers saying that the Obama administration is not after your guns, these guys in Missouri are on the same team. You really don't think they are acting on their own do you?

I suggest when they come to confiscate your gun when you don't turn it in giving them the ammunition first, then when you're out, throw the gun at them.

This is an all out gun grab and it is unconstitutional! It's unconstitutional at the Federal level and it's unconstitutional at the State level. The State Constitution, in Article 1, Section 23 of the Bill of Rights, reads:

Section 23. That the right of every citizen to keep and bear arms in defense of his home, person and property, or when lawfully summoned in aid of the civil power, shall not be questioned;

However, Missouri does go on to infringe upon the Second Amendment in the second half of Section 23 by stating, "but this shall not justify the wearing of concealed weapons."

Those on this site are quite familiar with the U.S. Constitution's Second Amendment. Now is not the time for complacency. The fight is in your back yard now, not just at the Capitol.

Citizens of Missouri, write and call your representatives and tell them to kill this bill, then voice your outrage at the treasonous actions of the representatives who sponsored and co-sponsored this legislation.

    Up until this article, I had faith these posts on Freedom Outpost were checked out and true. I have just chatted with a granddaughter in MO. who spoke with a close police officer friend, who is a gun enthusist, said it is pure bull, no such bill is being proposed, said it was a story to rally against any further gun control. Give it up people, we are lied to enough by the main stream media and now we may be asking ourselves , who do you work for?

    So, let me figure this out. "Law" abiding citizens sheepishly hand over their guns, but HOW are they going to get guns away from criminals? Do they even care?

    Add Missouri to my list of states to bypass on my trip down Route 66. I will not spend my money in any states that advocated violating my 2nd Amendment Rights. Apparently they want to turn their state into another area like Chicago or NY. Ban the guns and let the criminals go wild. Gross stupidity.

    I did wonder where Dianne Feinstein, Omniscient Obama and theeir minions received their divine inspiration to ban 22 caliber rimfires, and it now reasonably appears that the peculiar fixation on the lowly 22 rimfire rifle is directly lifted from their true mentors and role models-- Adolf Hitler and Dr. Wilhelm F. Frick, which gun ban laws Halbrook (2000) so thoroughly researches and presents as one of the Nazi tyrant's seven laws:

    "An innovation of the 1938 law was to ban .22 caliber rimfire cartridges with hollow point bullets, ... ."

    Charles please advise me as to where it is said that this was law.I think were it law , Freedom Outpost would not have said for the freedom loving people of Mo.to call and write their reps and tell them to shoot this bill down before it becomes law.

    though I am a gun owner and a patriot and agree with the concept of this article i am EXTREMELY concerned that you are now using tactics of the liberal press with the title of this article. IT IS NOT TRUE.
    It is proposed legislation, it is not legislation.
    There are some dumbocrats introducing these bills, they are not in effect. Get it right if you want us with a brain to trust you. otherwise you are like the obummer press even if your stand is correct you are wrong in the presentation and that is unforgiveable. Our side must be correct in what we present, we can not stoop to their level or we lose credibility.
