Indefinite Military Detention Of US Citizens To Be Signed Into Law By Obama


We've been trying to keep you aware of what has been taking place with the talks concerning the 2013 version of the National Defense Authorization Act (NDAA). We've covered the Feinstein amendment, which effectively did nothing, except to empower Congress to authorize the military at their whim to violate people's 4th, 5th, and 6th Amendment rights. But now the talks are all done and the legislation is headed for Barack Obama's desk to be signed into law soon, just as it was nearly one year ago today, including provision to use the military to indefinitely detain US citizens.

Previously, Senator Rand Paul (R-KY) voted for the Feinstein amendment to the NDAA. But then there came the hashing out of language in the bill and Paul blasted Senator John McCain (R-AZ) for stripping away the amendment.

“We had protection in this bill. We passed an amendment that specifically said if you were an American citizen or here legally in the country, you would get a trial by jury,” Paul said. “It’s been removed because they want the ability to hold American citizens without trial in our country. This is so fundamentally wrong and goes against everything we stand for as a country that it can’t go unnoticed.”

The problem with Paul's assertion is that there was no protection for anyone, whether they are a citizen of the US, a permanent resident or a visitor. Rights that are supposed to be protected under the Constitution be damned! Neither the NDAA, nor the amendment proposed protected one person who is on American Soil.

Paul called the NDAA an "abomination." It is that, but so was the Feinstein amendment and even more so because it was deceptive at its core.

The Senate easily passed NDAA 2013 by a vote of 81-14. The next stop is Obama's desk.

They passed it first in May and then the final passage took place one day before the Senate passed it; December 20.

UPDATE: Additionally some have asked for the language in the bill. Here is section 1033, which I provided a link to in the article. You can also read my comments and others on the article I wrote concerning this amendment and how it uses language to appear that it does not give authority to indefinitely detain citizens, while at the same time it gives power to Congress authorizes it. Congress gave their authorization (unconstitutional as it was) last year in Section 1023 of the 2012 NDAA.

SEC. 1033. PROHIBITION ON THE INDEFINITE DETENTION OF CITIZENS AND LAWFUL PERMANENT RESIDENTS.

Section 4001 of title 18, United States Code, is amended--

(1) by redesignating subsection (b) as subsection (c); and

(2) by inserting after subsection (a) the following:

‘(b)(1) An authorization to use military force, a declaration of war, or any similar authority shall not authorize the detention without charge or trial of a citizen or lawful permanent resident of the United States apprehended in the United States, unless an Act of Congress expressly authorizes such detention.

In the end Congress voted to remove the Feinstein Amendment.

    Pardon me for my ignorance, but how did this bill get through the House? Before O-blamer could sign it, it had to be through BOTH houses.....am I not correct? Otherwise, it has no value as a law, order, edict, etc. I can't believe the House would EVER approve such an abomination for the O-bama nation!

    EVERY Senator and Congressman/woman who voted for this bill should be impeached for violation the basis rights of citizens and breaking their oath to the people to protect and defend the Constitution. IF the President signs it, he should also be impeached and prevented from being sworn into office in January. This bill is a clear violation of the basis rights of EVERY citizen of this country. When will the people open their eyes and see what "Our Government" is doing?

    Now we know how the Chinese, Iranian, Russian, etc feel! When will Christians pray and fight for their rights that God gave them? Pastors in churches will not speak up and citizens have very little influence. So, "Where does [our] help come from?"

    What will be the breaking point? How much further will Americans let this incipient dictator drag us down? Is this anyway for freedom loving Americans to act? Impeachment must be on our agenda! If the generals and admirals are behind him and this bill gets passed with this amendment, Obama has secured his future in this country. Now home land security can do their sadistic deeds unrestrained by law and instead of criminals being in prison it will be the rest of us with no protection by what was known as the Constitution.     DID THE HOUSE VOTE ON THIS BILL ? IF THEY DIDN'T, IT HAS TO BE OKAYED BY
    BOTH HOUSES BEFORE THE PRESIDENT CAN SIGN OR VETO IT. NO BILL CAN BECOME A LAW UNLESS IT PASSES BOTH HOUSES OF CONGRESS AND THEN IT CAN BE SENT TO THE PRESIDENT TO SIGN. IF THERE IS ANYTHING OTHER THAN THIS PROCEDURE, IT CANNOT LEGALLY BE MADE A LAW. READ THE CONSTITUTION.

    The bill states that the military will do the imprisonment of US citizens. Please do not forget that a vast majority of the military hate this guy. They will not enforce this law. Also remember that the UCMJ states that a member can refuse to obey an illegal order. This is in direct violation of the Constitution.
    If this starts happening all hell is going to break out and all bets are off as to what will take place.

    You would think we had learned something from what was done to Japanese citizens during WWII but I guess not. One day this will be seen as the one of the darkest chapters in American History. For 80 years we condemned the former Soviet Union and others in their orbit of Communist influence for their gulags. Political prisoners were routinely imprisoned for the crime of disagreeing with the criminal thugs running their country. Now our own government has proven itself to be no better than the goons that ran those holes. It would be a good thing for the goons taking over our government to remember what happened to the majority of previous world tyrants. I'm sure Gadhafi, Saddam and others like them are thoroughly enjoying their time in Hell!
