Many Facebook friends of mine, as well as, several pundits, including those at the Examiner.com are speculating that Barack Obama could enforce the directive signed by President George W. Bush titled "National Security and Homeland Security Presidential Directive," or as it is most commonly referred to as NSPD-51, in the wake of Hurricane Sandy.
What is the National Security and Homeland Security Presidential Directive you ask? Well, most links to the directive now point to a landing page that is covered in Barack Obama "stuff". However the text of the directive is still obtainable. You can read the directive here. Specifically it states that its purpose is to establish "a comprehensive national policy on the continuity of Federal Government structures and operations and a single National Continuity Coordinator responsible for coordinating the development and implementation of Federal continuity policies. This policy establishes "National Essential Functions," prescribes continuity requirements for all executive departments and agencies, and provides guidance for State, local, territorial, and tribal governments, and private sector organizations in order to ensure a comprehensive and integrated national continuity program that will enhance the credibility of our national security posture and enable a more rapid and effective response to and recovery from a national emergency."
The directive loosely translates what a national emergency is. Jerome Corsi writes,
The “National Security and Homeland Security Presidential Directive,” with the dual designation of NSPD-51, as a National Security Presidential Directive, and HSPD-20, as a Homeland Security Presidential Directive, establishes under the office of president a new National Continuity Coordinator.
That job, as the document describes, is to make plans for “National Essential Functions” of all federal, state, local, territorial, and tribal governments, as well as private sector organizations to continue functioning under the president’s directives in the event of a national emergency.
The directive loosely defines “catastrophic emergency” as “any incident, regardless of location, that results in extraordinary levels of mass casualties, damage, or disruption severely affecting the U.S. population, infrastructure, environment, economy, or government functions.”
When the president determines a catastrophic emergency has occurred, the president can take over all government functions and direct all private sector activities to ensure we will emerge from the emergency with an “enduring constitutional government.”
Translated into layman’s terms, when the president determines a national emergency has occurred, the president can declare to the office of the presidency powers usually assumed by dictators to direct any and all government and business activities until the emergency is declared over.
Ironically, the directive sees no contradiction in the assumption of dictatorial powers by the president with the goal of maintaining constitutional continuity through an emergency.
The directive specifies that the assistant to the president for Homeland Security and Counterterrorism will be designated as the National Continuity Coordinator.
In other words, the directive brings all power under the President, instead of balancing the powers as the Constitution requires. This was a huge power grab by Bush. The Department of Homeland Security drew up the Federal Continuity Directive 1 (FCD1) in response to the Bush Directive, which was to "provide the operational guidance to implement this policy."
But that isn't the end. Barack Obama left Bush's NSPD-51 intact and quickly went beyond it. John Griffing wrote,
By way of executive proclamation, President Obama has secured for himself the power to declare martial law in the event of a national "emergency," real or contrived, and without the accountability typically required by the Posse Comitatus Act and the National Emergencies Act of 1976.
This is the legacy of the "conservative" Bush administration. National emergencies have now been transformed into power-grabbing devices thanks to the virtually unnoticed National Security Presidential Directive (NSPD) 51.
NSPD 51 empowers the president to co-opt all state and local government authority in the event that he declares a national emergency. This is a self-declared power not subjugated to the National Emergencies Act of 1976 as in previous directives.
President Obama quickly went beyond NSPD 51, signing an order creating a "Council of Governors" who would be put in charge of declaring martial law. The directive is in direct violation of Posse Comitatus and the Insurrection Act. This "Council of Governors" answers only to President Obama.
In October of last year, President Obama declared a national emergency in the midst of the much-hyped swine flu crisis. This declaration was largely overlooked. By combining his October declaration with the provisions of NSPD 51, President Obama can now be considered virtually uninhibited by Congress and free to flip the switch at any moment.
Now I can hear the cry from some who will cry "Conspiracy theory!" However, I ask you, why is it necessary to put all power of the United States in the hands of just one man? Why, with a Constitution such as our are things of this nature even tolerated? Could it be that the American people don't see tyranny when it is staring them in the face? I believe it is.
In fact, we can't even tell which Big Government candidate we want to vote for. We don't care if "our" team's jersey is in the White House administering all these power grabs, as long as it isn't those liberals. But friends, it doesn't matter who is in office should they choose to exercise this power, it will be devastating to our freedom!
So the question remains, with only five days to answer it. Will this directive be enforced? I sure hope not. This article is not to incite fear in you, but to make you aware of just how those who have obtained the office of the President have granted to themselves fiat power, apart from the Constitution and no one in Congress blinks an eye at it. In fact, they approve of it, yet we continue to elect the same kinds of people that will not do anything to reverse these kinds of executive orders and directives. There is absolutely no need for them. Keep your eyes open over the next few days.
