Wal-Mart Sued As Employee Rips Up Woman’s $100 Bills Calling Them ‘Fake’


0914-walmart_full_600It appears super giant store chain Wal-Mart is coming under attack after a mother attempted to pay for her items with two one hundred dollar bills. Apparently the employees thought the money was fake. Now Garcia has filed a lawsuit in the amount of $74,900 in damages.

So what happened? The Daily Mail reports,

A mother who says Walmart employees intentionally humiliated her after wrongfully ripping up two of her $100 bills while believing they were fake is taking legal action against the store.

In her recently filed complaint, Julia Garcia is seeking no more than $74,900 in damages after detained for four hours before customers in San Antonio, Texas who were told she had tried to use fake money.

It was in the early hours of December 18, 2010 while doing some Christmas shopping for her children that Ms Garcia claims she presented the first $100 bill as payment before it was taken with suspicion from her.

According to Garcia’s complaint she presented a $100 bill for payment. No detection pen was used to verify its authenticity. Instead the cashier spoke to another cashier, then returned and told Ms. Garcia her money was fake and proceeded to rip the bill in pieces.

The bill was then marked with a detection pen which indicated it was genuine and Ms. Garcia explained this as she has also worked in retail.

A store manager was called over and Garcia produced another $100 bill, which she alleges was taken by the manager and immediately ripped up. She was then detained and was told police had been called.

Police finally arrived two hours later and inspected the bills. Of course during this time Ms. Garcia was humiliated because apparently these Wal-Mart employees don’t know how to verify real money.

After other tests were performed, the officer told Garcia the employee had made a “terrible mistake.”

According to her complaint, ‘At this time, he attempted to hand Plaintiff the two torn $100 bills he had misappropriated from her. When Plaintiff objected to receiving torn bills, Officer Edwards instructed Manager Russell to replace the bills he had wrongfully taken and destroyed.’

The officer on the scene escorted her to her car after she had been detained for four hours.

Someone is fortunate if they don’t lose their job over this incident. In light of the new quantitative easing that is taking place these days, it won’t be long until those hundred dollar bills are worth about as much as Monopoly money. Until then Wal-Mart should be dealing harshly with both the cashier and the store manager.

    There is something majorly wrong with this story…
    If you handed a $100 bill to a cashier who in turn, tore it up…Why would you give them another one?
    Wouldn’t you be yelling for security, manager and police w/the 1st one?
    She should be given’ the $200 back, let Wal Mart bite the bullet, let her shop for a year free… HAAAA!!! $200 a shop!!!
    Let WM pay, keep it out of taxpayers courts…
    Their Mistake, let those 2 cashiers flip the bill….

    The Yankee Government, itself, through the EEOC and “Affirmative-Action” prevents Wal-Mart from being able to hire the best and brightest they can attract. I’m surprised there aren’t more incidents like this…

    I have observed that Walmart employees are sometimes those who would never be employed elsewhere. That may be either their social action to accomplish employment for the disadvantaged, or maybe just cheap labor, but the manager should have dealt with the contention much better. The manager – at least – should be well-trained and capable of reasoned action.

    What do you think will happen 10 or 20 years from now when all stores will be walmart and you dont have the ability to shop anywhere else? Don’t say it wont happen. No one thought walmart would put so many stores out of business but they did. Walmart was a good idea while Sam was alive but his children have run it into the ground with replacing quality products with cheap chinese trash.

      Walmart’s expansion is already slowing down. They have hit market saturation. In a few years, they will start to decline. Almost a hundred years ago, Montgomery Wards was the walmart of its time. Where are they now?

    I guarantee that these workers were young, stupid, and may have not ever seen cash in that denomination. There was a story about a McDonald’s worker that thought a 2 dollar bill was fake money. They have never seen anything over 100 dollars being paid with in cash. I’m not defending them–I’m commenting on how stupid our next generation really is, LOL

    Real damages? Four hours wages.
    Punitive damages? Enough to get management’s attention.
    Publicity? Ah, that is the real behavior modifier.
    The story, as told here, does verge on the incredible. My own experience with WalMart is that their employees are almost always “good neighbors”. It would be interesting to hear the testimony of an unbiased observer.
    Could WalMart have been set-up? I wonder.

    As a loyal Walmart shopper I can tell you that the employee was wrong in ripping the bills up. If he had the inclination that the bills were fake he should have call his supervisor for verification.
    Walmart was indeed wrong and must pay but not before firing the stupid jerk who caused this woman to be humiliated.

    I hope she gets every penny — not because Wal-Mart is at fault as a corporation, but because Wal-Mart is stupid enough to hire employees that would act so unprofessionally and stupidly to another person.

    Someone should jack-slap these employees and embarras them in front of customers before firing them.

      Settlements, such as this, are the same as corporate taxes – another cost of doing business that must be passed on to the consumer. Ms. Garcia deserves an apology from the store and especially from the employees in question; but, I don’t think she had $75k worth of damage done to her. Do you really believe that you and I should be punished at the check stand for this incident?

    I was an Assistant store manager. I left WMT on May 21 of this year… Ripping up a suspect bill was the last thing on my mind when I was called to situations like this… Walmart retail division is full of such idiot managers.

      This isn’t even a slap on the back of the hand for Wal-Mart.
      If it was me I would be asking for 10% of the stores net revenue for the week.
      After her lawyer takes the customary 40% plus costs she will end up with maybe $35k tops.
      You need to look at this from the perspective of one of the largest and most powerful retail corporations in the world versus one woman who has to live in the community where this took place. How would you feel if the gossips in your community started to spread rumors that you were some sort of counterfeiting criminal after being subjected to a similar humiliation?

      The “no more than $74,900″ total is because that is the limit for the court this action was filed in. The filing lists the particulars and states they should not exceed this limit so this case falls within the Court’s jurisdiction.

      4 hours has value. Money back of course. A little something for other complications caused by the employee’s stupid behavior.
      There is a big legal difference between “damages” and “punitive”
      One restores lost monetary value.
      The other punishes for misbehavior as an incentive to not do it again.
      An “almost” car accident has no damages, for example.

      Lot more than just 4 hours of time. If you feel that way, it should happen to you. She didn’t get to her car until 5:00 am after being illegally detained and her property destroyed, humiliated in front of everyone who entered or exited the store that night. If they did that to my wife, I would personally deal with the manager.
