Warrantless SWAT Team Raid & Helicopter Surveillance Deemed Legal


eradication-helicopterIt appears that the Bill of Rights is being violated by government more and more. There is not a day that goes by that we don’t see Amerian citizens rights being violated. Just recently, a Virginia Circuit Court Judge ruled that law enforcement officials did not violate the Fourth Amendment rights of a Virginia property owner when they carried out helicopter surveillance and a warrantless raid on the man’s 39-acre property.

The ruling was handed down by Circuit Court Judge Cheryl V. Higgins. Philip Cobbs was charged with misdemeanor marijuana possession. Cobbs becomes the latest in a string of incidents where the ‘war on drugs’ trumps the Constutional rights of citizens.

The Rutherford Institute reports,

“Philip Cobbs is merely the latest in a long line of Americans to find themselves swept up in the government’s zealous pursuit of marijuana,” said John W. Whitehead, president of The Rutherford Institute. “Despite the fact that Philip had no knowledge about the presence of what officials claimed were marijuana plants growing on his property, the Commonwealth had no photographic evidence to back up their claims, and it took the Commonwealth more than a month to issue a citation in the case, Cobbs was still charged with misdemeanor marijuana possession, which carries maximum penalties of 30 days in jail and/or a $500 fine—the circuit court is allowing this case to move forward. This is not at all what I would consider justice.”

Philip Cobbs, a 53-year-old former teacher who cares for his blind, deaf 90-year-old mother, lives on a 39-acre tract of land in eastern Albemarle County that has been in his family since the 1860s. On the morning of July 26, 2011, while spraying the blueberry bushes near his Virginia house, Cobbs noticed a black helicopter circling overhead. After watching the helicopter for several moments, Cobbs went inside to check on his mother. By the time he returned outside, several unmarked police SUVs had driven onto his property, and police in flak jackets, carrying rifles and shouting unintelligibly, had exited the vehicles and were moving toward him. The police officers claimed they had sighted marijuana plants growing on Cobbs’ property and ordered Cobbs to produce them. Distressed and intimidated by the show of force, Cobbs indicated his lack of knowledge about any marijuana plants on his property. In response, one of the police officers radioed up to the helicopter, which then directed the officers to an area in the yard where an oak tree had fallen. Within the limbs of the fallen tree and an adjoining bush were two plants protruding, which the officers claimed were the alleged marijuana plants. The police then asked to search Cobbs’ greenhouse, which turned up nothing more than used tomato seedling containers. Over a month later, Cobbs received a summons charging him with possession of marijuana under Va. Code § 18.2-250.1, which provides that “ownership or occupancy of the premises or vehicle upon or in which marijuana was found shall not create a presumption that such person either knowingly or intentionally possessed such marijuana.”

Mr. Cobbs has 39 acres. The majority of Americans have no idea how vast that amount of land is and there is no way that any land owner can know every plant and animals on his property when it is that size. Trust me. I have 44 acres and I do well to know what’s on two acres of it. But that is really not the issue. The issue is the police’s blatant disregard for the rule of law, the U.S. Constitution, and the individual rights of Mr. Cobb.

    Is it possible that the government thinks that a few marijuana plants warrant the cost of such force or is fear of the government being instilled into the American psyche? We are being “nudged into submission. We are being conditioned to fear the government. I fear for this country If Obama is not retired and a conservative Congress installed.

    Call them the “Yard Gestapo”. We had the same thing happen here in Los Angeles County. The sheriffs drove onto our property with 4 black SUV’s, at least 3 people piled out of each car with body armor on and rifles and shotguns at the ready while my wife and I were standing there in typical summer gear, shorts, t-shirts and flip flops. Fortunately for us they found NOTHING. I’m really glad they didn’t plant anything. We only have 6 acres. But due to that and other things going on here we are giving up on California and abandoning our house (purchased for $300K and now worth $112K according to the county assessor). Moving to Arizona so we can be with like minded folks who value their freedom and liberty and love our country and think it should be protected from despotic tactics such as these.

    The people of Virginia can always impeach this bum. If I lived there I would immediately look into the process for his impeachment or recall if he is elected. We do have redress, but only if the sheeple pursue it. What say you Virginia?

    Rreading these totally dumb comments, school yard fight. I must say what we need are women to ge this country right. Men just want to flex muscle & act fool. If we toss out the old and in with the new, then we can put people in office w/out the “old” pay to play game. duh! Men, “not all” go back to school, read a good book. Anything that will give you some sense. Then again, common sense is hard to come by. That’s why men do hard labor and women do the thinking.

    A judge is a failed, bottom of the barrel lawyer incapable of making a living as a lawyer; not the brighter stars in the universe, you know. Pays a crooked politician to make him or her a judge and we get circuit court judge Cheryl B. Higgins along with many, many more bottom of the barrel ex-lawyers now acting as judges who in concert, are systematically destroying the country piece by piece. Even I know the guy is innocent. They don’t teach common sense in law school, i guess.

    What’s even more frightening is that somehow, THEY zeroed in on two single branches protruding out from under a fallen tree ON that 39 acres. What eye-in-the-sky technology do they possess that can single out a plant like that? I know that with HAARP technology, entire areas are yielding up ‘new’ species of animals all at one time. Something unreal is ‘up there’ and it’s not for our benefit. There is already a law on the books (recent) which makes it illegal to grow your own food on your own property. Was this just a ‘training run’ for what’s next?

    We are closer each day to a complete civil war in our country, but this time its not the North V South or the East V West, it is the People against the Government. If sickens me to see how much of a Police State we have become. We have freedoms and rights stripped from us each and every day. Its too late for our Government to change, We have too many foreigners in office who are there because of money, not Love of what being an American is about. The military is run by the Government so its understandable that they will do what they are told when hell breaks loose.

    and am extremely embarrassed by this story.

    Well not everyone knows that hemp was a mandated crop at one time and everyone had to grow it. It was used for rigging on sailing ships. My grandfather grew it up to and into the first war. George Washinton wrote in his growing journal of separating the male from the female in his growing journal. The fact that Virginia is a colonal period state may imply a volunteer pland that was borne by birds via their exciment to this location or it was a leftover from a long gone time of sailing ships that required hemp rope and cables as rigging to promote commerce in the colonies. Intend here is the law and if there is no intent there is no violation. An examination of the plant would produce the filter for violation. If it was the sativa plant-long and stalky-and not the indica plant-short and bushy- then it was a volunteer from a bygone era. No fool would grow a sativa plant for its affects-except Geroge Washington……

    What a shame, where was the Police K-9 unit, the Dept of Homeland Security, the TSA, the EPA, the FBI and the CIA, surely this offense was serious enough to have all the agencies involved?
